TERMS + CONDITIONS
BOOKING WITH BOARDWALK GRAPHICS:
The client acknowledges that booking with the Boardwalk means that you are ready to take your business by the handles and have fun throughout the design process all at the same time. Although we, Boardwalk Graphics are all about providing an effortless and fun design experience, it is still pertinent that clients come to us with a vision and plan for their business. Knowing your business from the inside out will help us when it comes to branding for it. Take time out to create a clear vision of your brand.
The client acknowledges and agree that they will have and know the following prior to booking with Boardwalk Graphics:
KNOW YOUR BRAND (IDENTITY):
It is pertinent that you take time out to discover your brand's identity. What is your brand's name? What does your brand stand for? What is your brand's "story?" What are your brand's colors? Who is your target audience? (Who is your brand supposed to appeal to? What does your ideal customer/client look like? What do they do for a living? How much do they make?) Once your realize you can't market to just any and everyone and narrow down on who you will be marketing to, those ideal clients/customers will automatically flock to your business. Choose markets that will attract them. Know what you need and want to accomplish with your branding. Knowing your brand's identity will help you distinguish yourself from your competitors and will ultimately lead to a strong brand. Discovering who you are as a brand, will also lead to brand cohesiveness, which is what you should want as a business owner. Be intentional with your brand's identity.
It is always a good idea to come to us with an idea in mind. Though you make think you don't know what's best because you may not be a "designer," that is not the case. You must know what you want for your own brand. Research what others in your field are doing and research your likes and dislikes. The more details you give us when it comes to your wants and needs, the better. Phrases such as "just make it pop," "make it girly," "do what you feel is best," "use your designer's eye to choose a color scheme for me" will not work because we are not the owner of your brand nor do they explain your wants. So please be sure to come to us with your brand's identity AND inspiration because we are not mind readers. Our best work comes when you as the client give us more to work with.
KNOW YOUR BUDGET:
Investing into your own brand and branding is extremely important. It takes money to make money. Make sure you know how much you're willing to spend and scan our prices to see if it fits your budget. If you are interested in services with us but cannot afford it just yet, it is okay to save up for it and come back when you are ready to make a purchase. Always keep in mind that full branding packages are always the best route to take when investing into your brand. This is because it will cancel out having to continue coming back for pieces for your brand rather than obtaining everything for your brand all at once. Invest in yourself to get what you need and always remember that our prices here at the Boardwalk are non-negotiable.
The client agrees to pay Boardwalk Graphics, LLC 100% of the total project cost (or if applicable, a 50% deposit for websites and packages over $550) before any services are started on. If services are not paid in full (aside from website developments and packages), projects will not be started on and will delay the client’s original turnaround time. Boardwalk Graphics is responsible for the payment of all federal, state, and/or local taxes with respect to the services she performs for the client as an independent contractor. The client acknowledges that all prices are subject to change at any given time and becomes effective upon posting to the Boardwalk Graphics website. If there has been an agreed upon price between the client and the designer prior to the prices on the website changing, it will remain valid until full completion of said project. All project payments are currently accepted on WIX with a valid debit/credit card only and/or via invoice. Projects will not be started on until the payment has processed entirely and has been cleared.
Boardwalk Graphics, LLC agrees to produce project materials (the “work”) at the request of the client for fees agreed upon in advance and delivery of the work by an agreed-upon deadline. As long as the client provides the designer with all detailed information, items, images and materials needed to do so within the allotted time frame. Boardwalk Graphics, LLC agrees that she will be the sole author of the work, which will be original work and free of plagiarism.
The client acknowledges that he or she must place their order for a service/project with Boardwalk Graphics, LLC on their website (www.boardwalkgfx.com) or via email if the wanted service is not listed on the Boardwalk Graphics website. Order requests will not be processed and fulfilled until they are properly placed on our website and/or paid by a custom invoice.
It is the client’s responsibility to provide the designer with all needed information on their website and/or via email and provide the items requested for their specific project in a timely manner. For orders placed online (excluding packages, web developments and season pass orders), Boardwalk Graphics will not process, confirm any orders via email or load a client into the portal until all information is received from the client. Once the detailed information is submitted to the designer, the designer will proceed with the next steps in the design process. Projects that consist of a package, website or season pass order, will receive a confirmation email to proceed with the next steps in the design process after their order payment has been processed. Processing and confirmation emails are sent out to the client 1 - 3 business days after their order is placed.
If a project calls for it, it is the client’s responsibility to submit high quality professional photos to the designer. We do not accept any blurry, low quality photos. If stock photos are needed, we do provide them for an additional $30 fee, which covers all photos needed for the client's project. It is the client’s responsibility to provide Boardwalk Graphics with clear and concise verbiage for their project. Boardwalk Graphics is neither responsible nor liable for any grammatical errors or misspelled words that have been provided and submitted. The client must be sure to double-check any names, titles, phrases, and wording before submitting all information to Boardwalk Graphics.
REFUNDS + CANCELLATIONS:
Deposits and payments are 100% NON REFUNDABLE on services that have already been paid for, processed and started on. Due to the nature of our business, it takes time and effort to push out designs to each of our clients. We are unable to get our time refunded, which means there are absolutely NO refunds on any design work, service and project that has been purchased, processed and started on. Please be sure that you communicate effectively on your vision. We are here to work with you, not against you and we want the best for your brand. Which is why it's important to communicate all wants for your project. If a refund is requested BEFORE a client's service/project is started on, a refund may be issued out.
Charge-backs are deemed invalid and we as the designer will follow legal proceedings if a charge back is conducted. If a charge-back occurs for any reason in attempts to obtain your "refund" after a purchase or deposit has been made, the client agrees to pay the charge-back fee. If a deposit was made and a charge-back was conducted, the client agrees to pay the FULL amount (ALL FEES) associated and incurred from said litigation that will be filed against you. This means that if a service was $650 and you made a deposit of $325 then requested a chargeback, you will be responsible for paying the chargeback fee + the other half of the service in FULL. NO EXCEPTIONS.
ANY PERSON PURSUING TO GET A REFUND OR PROCEED WITH THE PROCESS OF OBTAINING A REFUND AFTER WORK HAS BEEN STARTED ON OR ISSUED OUT, WILL HAVE THIS CONTRACT VOIDED AND ALL SERVICES ORIGINALLY APPLIED FOR WILL NOT BE OBLIGATED TO BE COMPLETED UNLESS OTHERWISE STATED BY THE COMPANY OWNER REQUEST. ANY CHARGEBACK/REFUND CASES OPENED PER CLIENT ACTION IS SUBJECT TO LOSING ALL RIGHTS TO DESIGNS AND WILL NOT BE ALLOWED TO WORK WITH BOARDWALK GRAPHICS AGAIN IN THE FUTURE.
At any point in time if the client decides they no longer want the service or package they have purchased, they are welcome to decline further services but no refund will be issued and the contract will be voided, once client has agreed to not continue services rather it be verbally or in writing.
Both parties understand that the client and/or Boardwalk Graphics may terminate the service at any time if, for any reason, the relationship is deemed unsatisfactory by either party or something else comes up. Should the client cancel the project prior to its completion, the client acknowledges that there will be NO refunds issued out and all designs will remain the property of Boardwalk Graphics. If partial work has been given to the client and the client chooses to cancel the rest of their project after paying a deposit or paying for their project in full, NO refunds will be given out. However, the client will have sole ownership over the partial work that has been issued out. If a project is in it's final stage of completion and the client decides to cancel, ownership will be transferred over after complete payment is received.
TIME FRAME TO SUBMIT MATERIALS:
It is the client's responsibility to submit all information and verbiage for their desired project on Boardwalk Graphics website and/or via design form/email in their client portal if the client runs out of room on our website. On each order page, it describes what is needed for each individual project below the ordering form. The client acknowledges that any incomplete order forms and incomplete information, will result in a delay of their unique turnaround time. We will not process orders and send confirmation emails out until the client has provided ALL information deemed necessary for their project. We will not chase after you as the client, for your information. It is your responsibility to email your information and items over to us.
If all materials and information needed for the project and/or design is not provided to Boardwalk Graphics one ( 1 ) week following the initial date of purchase, the client is subject to one or more of the following:
1. Termination with no obligation of refund or services rendered.
2. Standard turnaround time restarts from the time all material is confirmed to be received by the designer.
The client acknowledges that each turnaround time varies and depends on the workload of Boardwalk Graphics, peak times and the type of project that has been purchased by the client. Each turnaround time is sent to the client in a confirmation email 1 - 3 business days after the initial purchase date of the project, as long as all materials have been submitted to the designer (Boardwalk Graphics) and their order is completed with all necessary information. If an order in incomplete or all materials are not submitted in a timely manner, this will result in a delay of their turnaround time. The client acknowledges that the date given to them is the date they will receive a draft of the items that have been purchased. The time that the client receives a draft of their project, will range anywhere from 10:00am cst - 12:00am cst.
The client acknowledges that should they have any questions regarding their project, that they will be able to see a task board of their project in their client portal and they are also able to ask for updates in their portal as well.
The client acknowledges that life happens and there may be things out of Boardwalk Graphics control that may cause a delay in the client receiving their project by their projected date. Cases that are out of Boardwalk Graphic's control, such as injury, illness, computer malfunctions, theft, a death in the family, a fire or any other natural disaster may result in a delay and the length at that point will be unpredictable. In the case of this happening, Boardwalk Graphics will effectively communicate this to the client to keep them updated on their project.
Drafts of the client's project will be provided to them on the date previously discussed between Boardwalk Graphics (unless an element of out Boardwalk Graphics control occurs.) Draft palettes and draft images of any kind are for viewing purposes only and will be marked with a sample watermark. The client acknowledges that drafts may not be copied, manipulated, or distributed to any other company or individual other than those directly involved with the project without prior permission from Boardwalk Graphics. Each and every single draft that is composed, is of direct ownership and property of Boardwalk Graphics.
After Boardwalk Graphics has received all information from the client, she will begin the designing process and provide the client with a draft of their project (ie: their souvenir.)
At this point, the client and designer, if applicable, will work diligently together in editing and otherwise reviewing the work prior to completion and launch. Once the client receives their draft(s), the client is allotted three (3) complimentary round of revisions to request any minor changes such as color changes, wording, fonts, placement, etc.
Any additional minor revisions (after the first 3 complimentary round of revisions) will be an additional $15 each on top of the original service fee unless a mistake was made on my behalf. (i.e: a typo.) The additional $15 revision round fee must be paid via invoice prior to us making the necessary changes requested by the client.
Website developments come with five (5) complimentary round of revisions. Any additional minor revision (after the first 3 complimentary rounds) will be an additional $15 each on top of the original service fee.
If a client would like to make changes to the overall design because he/she does not like anything about the original concept, then he/she must pay a $55 fee ($200 for website developments) for a completely new design.
Information provided for flyer designs that require me to physically type out the text will result in an additional $30 fee that must be paid prior to the design being released. If a flyer has to be redesigned due to lack of prior information given, it will also result in an additional $30 fee. Once you receive the final version of your flyer, post your flyer on any social media network of if you take a screenshot of the watermarked draft and post it to social media, it is not permitted to receive any additional changes or add-ons unless an editing fee of $30 is paid.
CLIENT APPROVAL + FILE DELIVERY/OWNERSHIP:
Upon acceptance of the work, the client accepts responsibility for any further processes in which this work is used (e.g. film outpost, printing, etc.) Boardwalk Graphics is not responsible for errors occurring in this work or projects related to this work after acceptance by the client. If the client posts any work created by Boardwalk Graphics on any social media platform they automatically approve the design.
After the client approves their final designs, all projects are sent to the client via email and dropbox.
Logo designs are sent in PNG (Portable Network Graphic, which supports transparency,) JPG (Joint Photographic Experts Group, which is used for storing digital photos and used by most digital cameras to save images - not recommended for print use,) and PDF formats. The .AI (Adobe Illustrator vector file, commonly used for logos and print media) and the .PSD (Adobe Photoshop file) are the sole property of Boardwalk Graphics. If the. AI files are needed for any printer and/or manufacturer, we will send the files to them personally after their information is provided to us at no additional charge.
Other digital projects (such as business cards, loyalty cards, 4x6 flyers , e-flyers, etc,) are sent in PNG or JPG formats. If a PDF file is needed for such digital projects, it is the client's responsibility to contact Boardwalk Graphics, LLC to provide that for you.
Boardwalk Graphics will have complete ownership of all core .PSD or .AI files, even after the copies have been finalized and supplied to the client. With the exception of the core files, you, the client will own rights to what has been purchased and provided to you. Boardwalk Graphics will always retain the right to utilize all final designs, or any versions of the designs created in the process. Ownership of these designs will result in Boardwalk Graphics using them for printed and online portfolios, and promotional and marketing materials. The client acknowledges and understands that all finalized work is subject to be used on Boardwalk Graphics website, Instagram page, and Facebook business page as well.
If the client would like to use their completed project and given files to Copyright and trademark what's theirs, that is their choice since they own what they have purchased.
Prints and shipping occurs 7 - 14 business days AFTER designs have been approved and finalized. This timeframe includes the printing processing time as well as the shipping time. We do not print on site. We collaborate with an outsourced vendor for prints - so please keep this in mind when ordering. Once items have shipped via UPS, visitors will receive a tracking number via email. Shipping cost is included in the price. If the client is late in approving their design, their printing and shipping times will BOTH be delayed and the original turnaround time will be pushed back.
Boardwalk Graphics, LLC includes their shipping price in the price of the service. The client will not be responsible for paying a separate shipping cost. Once the client has approved their proofs, giving Boardwalk Graphics the okay to print, the shipping process will begin (after the products have been printed.) Boardwalk Graphics is not responsible for any lost, stolen or damaged items once they have shipped. We cannot guarantee an exact delivery date, however, a tracking number will be provided to the client after shipments for you to track your product(s) yourself via email. All products being shipped, ships via USPS or UPS. If there are any items that have been lost, stolen or damaged, please refer to the USPS or UPS website regarding the matter. If you have a product with an exact deadline, please order in advance; even if you are applying our rush order services to ensure you obtain your products in time.
Boardwalk Graphics acknowledges that she may receive or have access to information, which relates to the Client’s past, present, or future products, vendor lists, creative works, marketing strategies, pending projects/proposals, and other proprietary information. The designer, Boardwalk Graphics agrees to protect the confidentiality of the client’s proprietary information and all physical forms thereof, whether disclosed to Boardwalk Graphics before this Agreement is viewed or afterward; unless strict confidentiality is requested by client in advance of the establishment of this contract, Boardwalk Graphics can display materials and final work created for Client on the Boardwalk Graphics Instagram and Facebook pages (@boardwalkgfx) and the official BWGFX website.
BRAND ASSIST CALLS/BRAND CONSULTATIONS:
The client understands that the only clients who are able to call us and get clarification and/or assistance with their brand or a service they've purchased from us, are our Gold Season Pass holders. All communication with those who are not a Gold Season Pass holder, will only have the opportunity to communicate with us via email. The client will refrain from asking the designer if they can call them, hold a telecommunication conference, or text them unless they have invested in a Gold Season Pass. All communication with non season pass holders are held via email ONLY for paper trail purposes.
ACCEPTANCE OF TERMS:
The client promises to pay for the services rendered by Boardwalk Graphics for the Work as agreed upon. Client agrees they have read, understood, and are considered legally bonded to these terms.
